Emergency Petroleum Regulation RVP

As a result of disruption in the fuel supply caused by Hurricane Harvey and to help minimize and prevent potential supply disruptions, the Department of Agriculture and the State Chemist filed a temporary rule today to waive ASTM Specifications in regard to Reid Vapor Pressure (RVP).  Today, in response to requests for a waiver under the Clean Air Act (CAA), the Environmental Protection Agency (EPA) issued a temporary waiver. 

Pursuant to the Petroleum Products Inspection Law, the Department has adopted regulations that include the federal Reid Vapor Pressure Standard.  The standard for this time of year is 9.0 psi RVP.  The federal waiver allows for the sale or distribution of winter gasoline with an RVP of 11.5 psi effective today through September 15, 2017.

The Department received a request from industry to allow for the sale of winter gasoline in order to simplify fuel supply at this time.

Based on the EPA waiver and the need in the request, the Department and the State Chemist, pursuant to the Law, filed a temporary rule with the Secretary of State today. The rule allows for the sale or distribution of winter gasoline with an RVP of 11.5 effective today through September 15, 2017.
